·        Prohibited items – items whose import into the country is prohibited.    

·        Items admitted conditionally – items whose importation into the country is allowed with the term if a document issued by the relevant authorities of the exporting country is presented.    

·        Items admitted without conditions – items whose import into the country is allowed.

Part II:
Conditions of admission of articles imported or in transit
 
1. Animals and animal products
 
1.1 Bees and leeches
 
Live bees or leeches must be enclosed in a box so constructed as to avoid all danger and to allow the contents to be ascertained.
 
1.2Animal products
 
Under the Import and Export Ordinance (Chapter 60), import licences are required for imports of frozen or chilled meat (including beef, mutton, pork, veal, lamb and offal of these food animals) and imports of frozen or chilled poultry (including domestic fowl, duck, goose or turkey and any parts or offal thereof), except for those imported in the personal luggage of a person for personal consumption or as gifts in an amount not exceeding 15 kg provided that the meat or poultry imports are accompanied by an official certificate as defined in the Imported Game, Meal and PoultryRegulations (Chapter 132AK). Prior written approval from the Food and Environmental Hygiene Department or a health certificate issued by a recognized authority is required before application for import licences is submitted to the Food and Environmental Hygiene Department.
Game and prohibited meat as defined under the Imported Game, Meat and Poultry Regulations, (Chapter 132AK), can only be imported into Hongkong with prior permission from the Food and Environmental Hygiene Department.
 
Section 11 of the Rabies Regulation, Chapter 421A, stipulates that no person shall import into Hongkong any animal, carcass or animal product except under and in accordance with a permit issued by the Department of Agriculture, Fisheries and Conservation. Under this Ordinance, “animal” means all members of the class mammalia (mammals) except human beings; “animal product” means parts or derivatives of a dog, a cat (e.g. dog skin, canine semen, canine plasma, etc.) or any animal that has been infected with rabies and “carcass” includes the undressed carcass of a mammal.
 
In addition, under the Animals and Plants (Protection of Endangered Species) Ordinance (Chapter 187), endangered species which includes mammals, birds, reptiles, amphibians, fish, invertebrates and plants, whether alive or dead or parts or derivatives and manufactured products such as stuffed specimens, skins, horns, meat, tusks, etc., are under strict import control. No import is allowed except under and in accordance with a licence issued in advance by the Director of the Agriculture, Fisheries and Conservation Department. Granting of a licence is not automatic and licences will not be granted for certain species.

1.3 Flies of the family Drosophilidae
 
Under the Plant (Importation and Pest Control) Ordinance (Chapter 207), any person who intends to import files of the family Drosophilidae (recognized as plant pests) has to apply to the Agriculture, Fisheries and Conservation Department for a written authorization before importation takes place. Files of the family Drosophilidae are admissible for biomedical research and exchanged between officially recognized institutions, and must be enclosed in a box so constructed as to avoid all danger
and to allow the contents to be ascertained.

2. Plants and plant products
 
2.1 General rule
 
Under the Plant (Importation and Pest Control) Ordinance (Chapter 207), import licences issued in advance by the Agriculture, Fisheries and Conservation Department are required for import of plants which are accompanied by a phytosanitary certificate issued by the exporting countries. Cut flowers, fruits, seeds and vegetables for consumption as well as plants produced in and imported from China (People's Rep.) are exempted from this requirement.
 
A separate licence issued in advance by the Director of the Agriculture, Fisheries and Conservation Department is required for the import of endangered plants under the Animals and Plants (Protection of Endangered Species) Ordinance
(Chapter 187). Granting of a licence is not automatic and licences will not be granted for certain species.

2.2 Cereals
 
Import licences are required for imports of rice, with or without husk, and milled or unmilled. Import licences for rice imported for local consumption are issued only to companies registered as stockholders under the Reserved Commodities (Control of Imports, Exports and Reserved Stocks) Regulations (Chapter 296A). No import licence shall be required in respect of any reserved commodity imported into Hongkong in the personal luggage of a person solely for his own consumption or as gifts, in an amount not exceeding 15 kg.

3. Agricultural and domestic pesticides
 
Import licences are required for imports of "pesticides", i.e.:
 
a     any insecticide, fungicide, herbicide, acaricide or any substances (whether organic or inorganic) or mixture of substances used or intended to be used for preventing, destroying, repelling, attracting, inhibiting or controlling any insect, rodent, bird, nematode, bacterium, fungus, weed or other form of plant or animal life or any virus, which is a pest; or
b    any substance or mixture of substances used or intended to be used as a plant growth regulator, defoliant or desiccant. Importers must be licenced under the Pesticides Ordinance (Chapter 133), and imports must be covered by Import Licences
under the Import & Export (General) Regulations (Chapter 60A). Applications for these licences should be submitted to the

8.1 General rule
 
All pharmaceutical products and medicines as defined by Section 2 of the Pharmacy and Poisons Ordinance (Chapter 138) are subject to licensing control. Imports of pharmaceutical product must be covered by import licences under the Import and Export (General) Regulations (Chapter 60A). 12. Paint, varnish, enamels and similar substances
 
These substances are admitted on condition that each package contains not more than a quarter of a gallon of these products, that they are packed according to the conditions laid down by the ruling concerning transport of liquids and enclosed in an hermetically sealed metal container or in a box which has a level-opening lid soldered to the box. An empty space of at least
7.5% of the volume of the box must be left as an air space in each box. Exceptionally, for an item weighing not more than 8 ozs
(gross weight), an hermetically sealed bottle may be used as internal container.
 
Butane gas lighters and refills for such lighters are admitted if packing conforms to an approved standard and the total amount of butane in any postal packet does not exceed 180 g.
 
 
13. Textiles and textile articles
 
Import licences issued by the Trade and Industry Department, or Import Notifications which are filed by importers who have obtained exemption from the licensing requirements under the TextilesTrader Registration Scheme, are required prior to importation. Textile products imported as personal effects or as gifts, fabric swatches imported by air not exceeding 0.8 min
size and sample yarn imported by air not exceeding 1.2 kg in weight in respect of each type of yarn are exempted from import licensing. A separate licence is required for the import of fabric or yarn containing hair of certain endangered animals under the Animals and Plants (Protection of Endangered Species) Ordinance (Chapter 187). Granting of a licence is not automatic and licences will not be granted for certain species.

Coins, precious stones, jewellery and objects of gold, silver and platinum and other valuables must be sent by registered or insured service. However, articles of a total value exceeding 2,500 HK $ must be sent by insured service.
 
 
15. Rough diamonds
 
Under the Import and Export Ordinance (Chapter 60) and its subsidiary legislation, the imports and exports of rough diamonds must be covered by valid Kimberley Process Certificates (Import) and Kimberley Process Certificates (Export) respectively issued by the Director-General of Trade and Industry. Certificates are issued to traders registered with the Trade and Industry Department as rough diamond traders.

16. Strategic commodities
 
All strategic commodities as specified in the schedules to the Import and Export (Strategic Commodities) Regulations (Chapter 60G), may only be imported into or in transit through Hongkong under an import and/or export licence. These may include high-performance computers, memory devices made from compound semiconductors, sophisticated communications systems, cryptographic software and equipment, high-precision machine tools, military items, chemical weapon precursors, certain biological agents and articles for use relating to nuclear, chemical or biological weapons are generally classified as strategic commodities. 18Arms and ammunition
 
Imports must be covered by an import licence. In respect of arms and ammunition which fall under the provisions of the Firearms and Ammunition Ordinance (Chapter 238), only holders of licences issued by the Hongkong Police Force will be issued with import licences. Where a single movement of ammunition for small arms in excess of 1000 rounds is involved, such a movement must be covered by a removal permit issued by the Mines Division, Civil Engineering and Development Department.

20. Import and export of waste
 
Under the Waste Disposal Ordinance (Chapter 354), import or export of any waste requires a permit, unless the waste is listed in the Schedule 6 of the WDO’s, uncontaminated and is for recycling or reuse. In addition, the import of hazardous waste from Liechtenstein and member states of OECD and EU has been banned since 28

21. Asbestos
 
Under the Air Pollution Control Ordinance (Chapter 311), import of amosite and crocidolite or any substance or item made with or containing amosite or crocidolite requires a permit unless the substance form an integral part on the structure of fittings of a ship brought into Hong Kong for repair or breaking up.

Part III:
Special provisions, Customs and other
 
1. Drawing up of Customs declarations
 
It is not necessary to indicate the net weight, except for alcoholic liquors, tobacco, hydrocarbon oils, methyl alcohol and articles containing alcohol and/or hydrocarbon oils liable to duty.
 
 
2. Need to insert ordinary or consular invoices, etc.
 
It is not necessary to include ordinary or consular invoices.
 
 
3. Need to attest to the origin of goods
 
It is not necessary to enclose certificates of origin. However, in many cases it is necessary for the addressee to obtain the relative import licence or permit or certificate of importation prior to taking delivery of the packet or parcel, and any inquiry regarding those goods which are subject to importation control should be addressed to the Director-General of Trade and Industry or the Commissioner of Customs and Excise, as appropriate.
 
 
4. Miscellaneous customs provisions
 
Dutiable goods as provided in Section 3.1 of the Dutiable Commodities Ordinance (Chapter 109), will not be released until the full duty prescribed by law has been paid.
 
An import declaration or an export declaration is required to be lodged with the Commissioner of Customs and Excise for postal packets the contents of which are valued at over 4000 HK $ within 14 days after its importation or exportation.
 
 
5. Provisions on infringements
 
5.1 The import and/or export of the products below without a valid licence/certificate issued by the Trade and Industry Department / Food and Environmental Hygiene Department would be an offence. Any person found guilty could be subject to the following penalties:

5.2 Under the Control of Chemicals Ordinance (Chapter 145):
 
i      it is an offence under Section 3 to import or export acetylating substances without a licence;
 
ii     unless with removal permit, it is an offence under Section 7 to remove any acetylating substances in Hongkong;
 
iii     under Section 15 of the Ordinance, any person who contravenes Sections 3 and 7 shall be guilty of an offence and shall be liable:
 
a   on conviction on indictment, to a fine of 1 000 000 HK $ and to imprisonment for 15 years; and b   on summary conviction, to a fine of 500 000 HK $ and to imprisonment for 3 years.
5.3 Under the Dutiable Commodities Ordinance (Chapter 109):
 
i      it is an offence under Section 17.3 to import or export goods to which the Ordinance applies except on the authority of a licence or permit;
 
ii      any person who contravenes Section 17 shall commit an offence and shall, in addition to any forfeiture which may be ordered, be liable to summary conviction to a fine of 1 000 000 HK $ and to imprisonment for 2 years under Section 46.
 
5.4 Under the Animals and Plants (Protection of Endangered Species) Ordinance (Chapter 187):
 
i      it is an offence to import and/or export endangered species of animals and plants, whether alive or dead or parts or derivatives without a valid licence;
 
ii     any person who contravenes the licensing requirement will be prosecuted and liable to a maximum fine of
5 000 000 HK $, imprisonment for 2 years and forfeiture of the specimens in question.
 
5.5 Under the Import and Export Ordinance (Chapter 60):
 
it is an offence under Section 6C to import or under Section 6D to export optical disc mastering and replication equipment without a licence;
 
under Section 6C of the Ordinance, any person who contravenes section 6C(1) shall be guilty of an offence and shall be liable:
 
a    on conviction on indictment, to a fine of 2 000 000 HK $ and to imprisonment for 7 years; and b    on summary conviction, to a fine of 500 000 HK $ and to imprisonment for 2 years;
under Section 6D of the Ordinance, any person who contravenes Section 6D(1) shall be guilty of an offence and shall be liable:
 
a    on conviction on indictment, to a fine of 2 000 000 HK $ and to imprisonment for 7 years; and b    on summary conviction, to a fine of 500 000 HK $ and to imprisonment for 2 years.
5.6 Any person who conducts a controlled waste shipment without a valid WDO permit commits an offence and is liable
to a fine of 200 000 HK $ and imprisonment for 6 months for the first offence, and a fine of 500 000 HK $ and imprisonment for 2 years for the second or subsequent offence.
 
5.7 A person who imports amosite and crocidolite or any substance or item made with or containing amosite or crocidolite without a permit commits an offence and is liable to a fine of 200 000 HK $ and to imprisonment for 6 months.
